Terms of Service

By creating an account and using PayToSocial, you agree to these Terms of Service. If you don't agree, please don't use the service.

These terms create a legal contract between you and PayToSocial FZ-LLC. We may update these terms occasionally—if we do, we'll notify you via email 30 days before changes take effect.

You must be:

• At least 18 years old
• Able to enter into legally binding contracts
• Not prohibited from using the service under applicable law

Creating your account:

• You must provide accurate, current information
• You're responsible for maintaining account security
• Don't share your password or let others access your account
• Notify us immediately if your account is compromised

One account per person:

• You may only create one account
• If you need multiple accounts for businesses, contact us

Account termination:

• You can delete your account anytime (Settings → Delete Account)
• We can suspend or terminate accounts that violate these terms
• Unpaid balances remain due even after termination

Pay-per-post pricing:

• You pay $0.75 for each post that is successfully published
• No charge if you cancel a post before it publishes
• No monthly subscription fees
• Prices may change with 30 days notice (existing scheduled posts stay at old price)

Payment processing:

• Payments are processed via Stripe
• You authorize us to charge your payment method for published posts
• Failed payments may result in service suspension

Refunds:

• Non-refundable: Once a post is published, charges are final
• Refundable: If we fail to publish a post due to our error, you get a full refund
• Not our fault: No refunds if posts fail due to social platform API changes, account bans, or policy violations

Taxes:

• Prices don't include sales tax, VAT, or other local taxes
• You're responsible for paying applicable taxes

You may use PayToSocial to:

• Schedule and publish legitimate social media content
• Manage multiple social accounts you own or have permission to access
• Promote your business, products, or services
• Post content to TikTok and other platforms in compliance with each platform's terms of service and community guidelines

You may NOT:

• Spam: Automate, bulk post, or violate platform policies
• Violate platform terms: Post content that violates TikTok, Twitter, LinkedIn, Facebook, Instagram, YouTube, Pinterest, or Snapchat terms of service or community guidelines
• Illegal content: Post anything illegal, fraudulent, or harmful
• Hate speech: Post racist, sexist, or discriminatory content
• Impersonation: Pretend to be someone else or misrepresent yourself
• Abuse: Harass, threaten, or bully others
• Malware: Distribute viruses, malware, or phishing links
• Unauthorized access: Hack, scrape, or reverse engineer the service
• Reselling: Resell or white-label PayToSocial without permission
• TikTok-specific: Violate TikTok Developer Terms of Service, TikTok Data Sharing Agreement, or misuse TikTok's Content Posting API

Violation consequences:

• Account suspension or termination
• Loss of scheduled posts
• No refunds for paid posts
• Legal action if necessary

Your content:

• You own all content you create and post
• You grant us a license to store, process, and publish your content
• This license ends when you delete content or your account
• You're responsible for ensuring you have rights to post content (images, videos, text)

Our service:

• PayToSocial owns all code, design, branding, and features
• You may not copy, modify, or create derivative works
• You may not use our name or logo without permission

Uptime:

• We aim for 99.9% uptime
• Scheduled maintenance will be announced 48 hours in advance
• We're not liable for downtime caused by third parties (AWS, social platforms)

Social platform changes:

• PayToSocial relies on APIs from TikTok (Content Posting API), Twitter, LinkedIn, Facebook, Instagram, YouTube, Pinterest, and Snapchat
• If any platform changes their APIs, policies, or terms of service, features may break temporarily
• We're not responsible for posts failing due to platform changes, API deprecations, or policy updates
• We'll work to fix issues as soon as possible, but can't guarantee timelines (platform API changes are beyond our control)
• TikTok-specific: If TikTok updates their API requirements or disables developer access, posting to TikTok may be temporarily or permanently unavailable

No guarantees:

• We don't guarantee posts will publish successfully 100% of the time
• We don't guarantee your social accounts won't be banned (follow platform rules!)
• We don't guarantee specific post performance or engagement

To the maximum extent permitted by law:

• PayToSocial FZ-LLC is provided “AS IS” without warranties of any kind
• We're not liable for lost profits, data, or business opportunities
• Our total liability is limited to the amount you paid in the past 12 months
• We're not liable for issues caused by third-party services (AWS, Stripe, social platforms)

Indemnification:

• You agree to indemnify PayToSocial FZ-LLC against claims arising from your use of the service
• This includes legal fees if someone sues us because of content you posted

Governing law:

• These terms are governed by the laws of California, USA
• Disputes will be resolved in San Francisco County courts

Arbitration:

• Most disputes will be resolved through binding arbitration (cheaper and faster than court)
• You waive the right to participate in class-action lawsuits
• Small claims court remains available for disputes under $10,000

We reserve the right to:

• Modify, suspend, or discontinue the service at any time
• Add or remove features
• Change pricing with 30 days notice
• Update these terms with notice

If we make material changes that negatively affect you, you may terminate your account within 30 days and receive a pro-rated refund for unused scheduled posts.
